DodoPrime Membership โ€” Terms & Conditions

These DodoPrime Membership Terms & Conditions ("Membership Terms") govern your purchase and use of the DodoPrime Membership provided by Consumer Recreation Services Ltd ("DodoMarket", "we", "us", "our"). By purchasing or using DodoPrime, you agree to these Membership Terms, our Website Terms of Service and our Privacy Policy. If you do not agree, please do not purchase or use the membership.

1) Key Benefits (What You Get)

  • Free standard delivery island-wide on eligible orders of Rs 1,999 or more for 12 months.
  • Reduced delivery rates on orders below the free delivery thresholdโ€”you pay less than non-members on every order.
  • Same-day & surge-date savings: when you choose same-day delivery or order during a surge period, members always pay reduced rates compared to non-members.
  • Member discount on eligible products, automatically applied at checkout where applicable.
  • Early access to certain drops, pre-orders and flash sales, where available.
  • Priority support via WhatsApp, 7 days a week.

2) Eligibility & Account

  • You must be at least 18 years old and able to form a binding contract under Mauritian law.
  • DodoPrime is for personal consumer use only. It is not transferable, and it may not be used for resale, wholesale, courier, or other commercial purposes.
  • Benefits apply only when you are signed in and place orders from the same DodoMarket customer account that holds the active membership.

3) Membership Term, Activation, Renewal & Expiry

  • Term: 12 months (365 days) from activation on your customer profile.
  • Activation: This is a digital product; once purchased, we update your profile and benefits begin shortly thereafter.
  • Renewal: DodoPrime currently does not auto-renew. We typically send reminder emails around 30, 7 and 1 day before expiry. If you do not renew, benefits end on the expiry date.
  • If we introduce optional auto-renew in the future, we will notify you clearly in advance and obtain your consent; you will be able to opt out at any time before renewal charges are applied.

4) Delivery Coverage, Order Requirements & Limitations

  • Coverage: We deliver across Mauritius. Delivery benefits apply where our delivery service is available.
  • Minimum order: A minimum order value of Rs 999 is required to proceed to checkout. Orders below this threshold cannot be completed.
  • Free delivery threshold: Free standard (next-day) delivery applies to eligible orders of Rs 1,999 or more. Orders between the minimum order value and the free delivery threshold qualify for reduced member delivery rates.
  • Same-day orders: Available when the order is placed and paid before the published cut-off time on the delivery day. Same-day delivery is subject to an additional fee, though members pay a reduced rate compared to non-members. Same-day slots are capacity-dependent and may be unavailable on peak or surge dates.
  • Surge periods: During designated peak periods (including but not limited to Christmas, Valentine's Day, and Mother's Day), delivery rates are adjusted to reflect increased demand. Free delivery may be suspended during surge periods; however, members continue to receive reduced rates compared to non-members.
  • Timing: Delivery is guaranteed for the selected date, but a specific time window is not guaranteed. Most orders arrive in the early afternoon; conditions can vary.
  • Preparation lead-times: Some products (e.g., birthday cakes) require advance notice (typically 48 hours). Such items are not eligible for same-day delivery.

5) Exclusions & Fair Use

  • Discount exclusions: The member discount applies only to eligible products as designated on the product page or at checkout. Products may be excluded from member discounts based on product type, supplier agreements, promotional restrictions, or margin constraints. Unless stated otherwise, member discounts cannot be combined with certain coupon codes or partner/affiliate offers.
  • Delivery exclusions: Free or reduced delivery may not apply to oversized items, special-handling items, remote-origin products, or deliveries outside normal service zones. Where excluded, applicable delivery or special surcharges may still apply.
  • Fair use: DodoPrime benefits are intended for normal personal consumer use. We reserve the right to review accounts with unusually high order volumes, delivery frequency, or patterns inconsistent with typical household use. Where we reasonably determine that benefits are being misused, exploited, or used for commercial purposes, we may adjust, suspend, or cancel membership benefits.

6) Fees, Taxes & Changes

  • Membership fee: The fee displayed at purchase applies for the 12-month term.
  • Taxes: Any applicable taxes will be shown at checkout; pricing and tax treatment follow Mauritian law.
  • Program changes: We may modify the program at any time, including but not limited to benefits, thresholds, delivery rates, discount eligibility, surge period designations, and other program features. Such changes may be made to reflect operational, commercial, legal, or seasonal requirements and may take effect without prior notice. Your continued use of DodoPrime benefits after any changes constitutes acceptance of those changes. If you do not agree to any changes, you may cancel your membership in accordance with Section 7.

7) Cancellations & Refunds

  • Change of mind: If you have not used any DodoPrime benefits (no order placed with any member discount applied and no delivery benefit utilised), you may request a full refund within 14 days of purchase. After benefits have been used, the membership fee is non-refundable.
  • Our right to cancel: Where we reasonably suspect or detect misuse, fraud, or breach of these Membership Terms, we may suspend or cancel your membership. Depending on the circumstances, we may decline a refund.
  • This section does not limit any non-excludable rights you may have under Mauritian law.

8) Privacy & Data Protection (Mauritius DPA 2017)

  • We process your personal data to administer DodoPrime, apply benefits at checkout, manage renewals/reminders, and provide support. Our processing follows the Data Protection Act 2017 (Mauritius) and our Privacy Policy.
  • Service notifications (e.g., activation/expiry reminders) are necessary to operate your membership. You can opt out of promotional marketing at any time using the methods described in our Privacy Policy.
  • You may exercise your data rights (access, rectification, erasure, objection, etc.) by contacting us (see "Contact Us").

9) Electronic Contracting & Notices

  • You agree that electronic acceptance, records and communications satisfy any legal requirement for written form under the Electronic Transactions Act 2000 (Mauritius), to the extent permitted by law.
  • We may send you membership-related notices by email or through your DodoMarket account.

10) Liability, Service Interruptions & Force Majeure

  • To the maximum extent permitted by Mauritian law, DodoMarket is not liable for: (i) delays or failures caused by events beyond our reasonable control (including severe weather, traffic, peak-season capacity constraints, strikes, or third-party carrier issues); or (ii) indirect, incidental or consequential losses related to the membership.
  • Nothing in these Membership Terms excludes or limits liability where such exclusion or limitation would be unlawful (including liability for fraud).

11) Governing Law & Disputes

These Membership Terms are governed by the laws of the Republic of Mauritius. Courts in Mauritius shall have exclusive jurisdiction over any dispute, without prejudice to any mandatory provisions of Mauritian consumer law that apply for your protection.
